Recently, the Garante has also stressed the importance of carrying out checks on all those who are intermediaries in the management of electronic invoices, as they actually process particularly sensitive data:
Under the lens of the Guarantor also other sectors of high criticality: …data processing carried out by intermediaries offering electronic invoicing services.
Reading the latest news, it becomes increasingly clear that the main data managers are increasingly exposed to the risk of attacks and data breaches, precisely to try to access information assets as important as the data contained in electronic invoices, which not only represent the history and successes, but precisely define the company DNA.
For this reason, the Guarantor has raised the alarm by talking about how this wealth of data may be exposed to possible risks.
The full archiving of all e-bills issued and received, including non-tax relevant data and those relating to the services provided, is “disproportionate”. As such, it runs the risk of contravening the principle of proportionality of data indicated as a benchmark by the EU Court of Justice. Moreover, the measures to prevent such sensitive information assets from being exposed to risks of “exfiltration or cyber attacks” should be identified by legislation and not by measures of the Guardia di Finanza and the Agenzia delle Entrate.
